ROADSIDE ASSISTANCE & TOWING SERVICES

1. LEGAL STATUS OF COMPANY

These Terms and Conditions (“Agreement”) constitute a legally binding contract between Company ASSISTO ROADCARE RSA PRIVATE LIMITED, a company incorporated under the Companies Act, 2013, having its registered office at Address SNO.132/9 SHRI SAI HSG, SOC C/11 GURUDWARA, Chinchwadgaon, Pune, Pune City, Maharashtra, India, 411033] (hereinafter referred to as “Company”), and the customer requesting services (“Customer”). By booking, requesting, subscribing to, or using the Company’s services via phone, website, mobile application, or any electronic mode, the Customer agrees to be legally bound by this Agreement in accordance with applicable Indian laws including electronic contract validity provisions. Subject to availability and safety conditions, Company shall provide:

2. NATURE of Services (24x7):

The Company provides minor roadside assistance for,

  • Flat Tire support

  • Clutch, brake, mechanical and electrical issues

  • Fuel assistance (delivery only fuel cost payable by Customer petrol/diesel emergency delivery,

  • jump start and battery support,

  • Breakdown towing services; and

  • Hotel assistance arrangement services.

All services are available 24×7 rendered by trained mechanical personnel. &, subject to accessibility and operational feasibility.


3. PAYMENT TERMS-:

3.1 Customer shall pay all charges applicable to services, spare parts, fuel, consumables, hotel stay, third-party vendor services, tolls, parking, or statutory fees.

3.2 Any service not covered in the subscribed plan shall be chargeable.

3.3 Payment must be made immediately upon completion of service unless otherwise agreed in writing.

3.4 Non-payment shall entitle Company to withhold service or retain vehicle as permitted by law.


4. FREE TOWING LIMITE POLICY-:

Free towing is limited to 25 kilometers only. Distance beyond 25 km shall be charged per kilometer at prevailing Company rates and conditions shall be payable by the customer. Charges vary depending on vehicle type, condition, time, and equipment used.


5. CUSTOMER OBLIGATIONS-:

Customer warrants that:

  • They are lawful owner or authorized user of the vehicle.

  • All information provided is true and accurate.

  • Vehicle does not contain illegal or hazardous material.

  • Customer will cooperate with service personnel.

  • Customer shall indemnify Company against any loss caused by false information or unauthorized request.

By availing services, the customer enters into a legally binding agreement under the INDIAN CONTRACT ACT, 1872 and agrees to be bound by these Terms & Conditions.


6. SERVICE LIMITATIONS-:

Services are subject to:

  • Geographic reach

  • Weather conditions

  • Road accessibility

  • Mechanical feasibility

  • Safety of personnel

  • Government or police restrictions

All towing & road side operation shall be conducted in accordance with applicable provision of the Motor Vehicles Act, 1988 & rules framed there under. Company reserves the right to refuse or discontinue service if conditions are unsafe, unlawful, or technically impracticable.


7. LIABILITY LIMITATION-:

7.1 Company shall not be liable for:

  • Pre-existing damage

  • Mechanical or electrical failure not caused during service

  • Loss or theft of items left inside vehicle

  • Delays due to traffic, strikes, natural events, or force majeure

7.2 Company’s maximum liability, if proven, shall not exceed the service fee paid for that particular service.


8. DAMAGE CLAIM PROCEDURE-:

Any claim must:

  • Be reported immediately at delivery time

  • Be supported by photographs or written record

  • Be submitted within 24 hours

  • Claims reported later shall not be entertained.


9. THIRD-PARTY SERVICES-:

Company may arrange third-party mechanics, hotels, or vendors. Such services are independent and Company shall not be responsible for their acts, omissions, pricing, or quality.


10. ELECTRONIC CONTRACT VALIDITY-:

Acceptance of these Terms by clicking “I Agree,” booking online, digital signature, OTP verification, WhatsApp confirmation, email confirmation, or payment shall constitute valid acceptance and enforceable electronic consent.


11. CANCELLATION REFUND & POLICY-:

  • If service is cancelled after dispatch, call-out charges shall apply.

  • If technician reaches location, full service charge may be payable.

  • Fees once paid are non-refundable unless Company fails to provide service due to its own fault.


12. INDEMNITY-:

Customer agrees to indemnify and hold harmless Company, its directors, employees, drivers, contractors, and agents against all claims, losses, damages, legal costs, or liabilities arising from Ownership disputes Unauthorized requests Illegal use of vehicle Third-party claims


13. TERMINATION OF SERVICE RIGHTS -:

Company may suspend or terminate services immediately if:

  • Customer behaves abusively or unlawfully

  • Payment is refused

  • Fraud or misuse is suspected

  • Safety risk exists


14. FORCE MAJEURE-:

Company shall not be liable for failure or delay caused by events beyond reasonable control including natural disasters, riots, government restrictions, strikes, or infrastructure failure.


15. Consumer Rights-:

Nothing in these terms shall restrict or exclude statutory rights available under the Consumer Protection Act, 2019


16. INTELLECTUAL PROPERTY-:

All website content, trademarks, logos, and service marks belong to Company and may not be used without written consent.


17. Data & Privacy Compliance-:

All customer data shall be processed in accordance with applicable provisions of the Information Technology Act, 2000 and related rules regarding data protection. Customer consents to collection and use of personal and location data for service delivery, verification, safety, and legal compliance.


18. GOVERNING LAW & JURISDICTION-:

This Agreement shall be governed by laws of India. All disputes shall be subject to exclusive jurisdiction of courts located at Pune only.


19. AMENDMENTS-:

Company reserves the right to modify these Terms at any time. Updated Terms shall become effective upon publication on website or notification to Customer.


20. COMPLETE AGREEMENT-:

This document constitutes the entire agreement between parties and supersedes all prior communications.
